Terms of Service

1. Who these terms are with

NxtDue ("NxtDue", "the app", "we", "us") is operated by Chandu Mahesh, an individual carrying on business as a sole proprietor registered in India, at S/O Chengaiah, Surapu Agraharam Village, Kalluru Post, Doravari Satram Mandal, Nellore, Andhra Pradesh 524123 ("the operator").

These Terms of Service ("Terms") are an agreement between you and the operator, and they govern your use of the NxtDue mobile app, the NxtDue website at nxtdue.com, and the NxtDue service behind them (together, "the Service"). By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.

Our Privacy Policy explains what we collect and why. It forms part of these Terms.

2. Who can use NxtDue

You must be 18 years of age or older to create an NxtDue account. The Service is not directed at children, and we do not knowingly allow accounts for people under 18. If you invite someone to a family space, you confirm they are 18 or older too.

You must be able to enter a binding contract, and you must not be barred from using the Service under the laws that apply to you.

3. Your account

You sign in with your email address (or your mobile number) and a password. We send a one-time code to your address to confirm it is yours before the account can be used, and again if you ask to reset your password. That makes your email address — and whatever protects it — the key to your account: keep it secure, and tell us at once if you believe someone else has access.

  • One account per email address.
  • Give an address you actually control. If you lose access to it, you lose the ability to reset your password.
  • A mobile number is required to create an account. Give a number you actually control, and remove it before the number is reassigned to someone else.
  • You are responsible for activity that happens through your account.
  • Do not share your one-time codes or your password with anyone, including anyone claiming to be us. We will never ask for either.

4. What NxtDue is — and is not

NxtDue is a personal organiser for expiry and renewal dates. You enter the dates, and the Service attempts to notify you before they arrive.

NxtDue is a reminder tool, not a guarantee. Notifications depend on your device, your operating system's power and notification settings, your network, and third-party push services we do not control. A notification may be late, or may not arrive at all. You remain responsible for your own renewals, policies, filings and payments. Do not rely on NxtDue as your only safeguard for anything whose lapse would cause you loss.

NxtDue does not provide legal, financial, tax or insurance advice, does not act as an agent or broker, does not sell or renew any product on your behalf, and does not make payments for you. Any figure you record in the app is a note you wrote, not a statement by us about what you owe or to whom.

5. Your content

Everything you put into NxtDue — your reminders, notes, amounts, and the documents you upload — remains yours. You keep all rights in it.

You grant us a limited, worldwide, royalty-free licence to store, copy, transmit and display that content solely so that we can operate the Service for you: keeping it safe, showing it back to you on your devices, delivering your notifications, and sharing it with the people you choose to share it with. This licence exists for no other purpose, ends when you delete the content or your account, and does not let us publish your content, sell it, or use it to advertise to you or anyone else.

You are responsible for what you upload. Do not upload anything you do not have the right to store, and do not upload another person's documents without their agreement.

6. Acceptable use

You agree not to:

  • break the law, or use the Service to help anyone else break it;
  • upload malware, or content that infringes someone's rights;
  • attempt to access another person's account or data;
  • probe, scan or attack the Service, or try to get around its rate limits, quotas or security;
  • use automated means to create accounts, or to extract data at scale;
  • resell, sublicense or commercially redistribute the Service; or
  • reverse engineer the app except to the extent that law expressly permits it.

7. Plans, prices and billing period

NxtDue offers a Free plan and one paid plan, Premium. Premium is sold either monthly or yearly; the yearly price is the cheaper of the two per month.

The price does not vary by country. It varies by the store you installed the app from, because Apple and Google run their own pricing tiers and NxtDue is priced once in each: the Google Play price is in Indian rupees and the App Store price is in US dollars, and each applies to every country that store serves. Your store may display the amount converted into your local currency, and it always shows the final figure, including any applicable taxes, before you confirm.

Paid plans are sold as in-app purchases through the Apple App Store or Google Play, depending on where you installed the app. The store takes the payment, shows you the final price including any applicable taxes before you confirm, and issues the receipt. We never see or store your card or payment details.

If a paid plan is not yet offered in your store or your region, only the Free plan will appear in the app. A Premium subscription is attached to your NxtDue account, not to the device it was bought on — but it is managed and renewed by the store that took the payment, so cancel it there, and buying again on the other store starts a separate subscription at that store's price. Nothing in these Terms obliges you to buy anything.

8. Automatic renewal

Yes, paid plans renew automatically. Specifically:

  • A Premium subscription renews every month, or every year, until you cancel it — whichever billing period you chose when you subscribed.
  • Your store account is charged for the next period within 24 hours before the current period ends, at the price then shown for the plan.
  • Renewal happens unless you cancel at least 24 hours before the end of the current period.
  • Switching between the monthly and the yearly price is done in your store, which applies its own proration rules to the change.
  • You can see the exact next renewal date at any time in your App Store or Google Play subscription settings.

9. How to cancel

You cancel in the store that took your payment — not with us, and you never have to write to anyone or explain why.

  • iPhone / iPad: Settings → tap your name → Subscriptions → NxtDue → Cancel Subscription.
  • Android: Google Play Store → your profile icon → Payments & subscriptions → Subscriptions → NxtDue → Cancel subscription.

Cancel at least 24 hours before the renewal date to avoid being charged for the next period. After you cancel, your paid features continue until the end of the period you have already paid for — cancelling does not shorten it, and no part-period refund arises for the remainder.

Deleting the app does not cancel a subscription, and neither does deleting your NxtDue account. Both stores keep the subscription running until you cancel it in the store itself. Please cancel there first.

10. When a paid plan ends

Whether you cancel, a payment fails, or a subscription simply lapses, the outcome is the same, and the first rule of it is that nothing you created is deleted:

  • Nothing you created is deleted. We do not delete reminders, documents or family spaces because a subscription ended. What the Free plan does not include is locked — kept, listed, and yours to delete — never removed.
  • You keep Premium until the end of the period already paid for. After that the account returns to the Free plan and its limits apply.
  • Reminders: the 10 due soonest at that moment stay active — visible, editable, and sending notifications as before. Any others are locked: they stay in your list, but they do not send notifications and cannot be edited, renewed or shared until you subscribe again. You can delete a locked reminder at any time. Deleting any reminder frees a slot, and the locked reminder due soonest takes it. You will not be able to create new reminders until you have fewer than 10.
  • Documents: your first 100 MB of uploads, in the order you uploaded them, stay viewable and downloadable. Files beyond that are locked — kept, listed, and yours to delete, but not viewable or downloadable until you subscribe again. Documents attached to a locked reminder are locked with it. Deleting files frees room, and the next locked file that fits is unlocked. New uploads stop until you are below 100 MB or you subscribe again.
  • WhatsApp delivery stops. Active reminders continue to arrive by push notification and email, which are on the Free plan.
  • Email receipt detection continues — it is a Free plan feature — and your Gmail connection is left alone.
  • The shared family space is paused: it is not deleted and nobody is removed, but while the owner is on Free, everyone in it — the owner included — sees only the reminders and documents they own, receives notifications only for those, and nothing new can be shared into it. Members keep everything in their own accounts. When the owner subscribes again, the space works as before, with nothing to redo.

Subscribing again unlocks everything at once. Your data is retained on the Free plan for as long as your account exists. It is deleted only when you delete it — see section 19.

11. Refunds

Because Apple and Google take the payment, they also handle refunds, and their policies govern:

  • App Store purchases: request a refund from Apple at reportaproblem.apple.com. Apple decides the outcome. We cannot issue a refund for an App Store purchase.
  • Google Play purchases: request a refund through the Google Play Store. Google's published refund policy applies, including its self-service window shortly after purchase. After that window Google may direct the request to us.

Where a store directs the request to us, write to the address on our support page within 30 days of the charge, telling us the store, the date and the amount. We will consider it in good faith and reply within 5 working days. We will normally refund the most recent charge where the Service did not work as described and we could not fix it.

Except as set out above, subscription fees for a period already begun are non-refundable, and we do not refund part months or part years. None of this limits any mandatory right you have under the consumer law of the country you live in — including India's Consumer Protection Act, 2019, and the statutory withdrawal and conformity rights of EU and UK consumers — which continue to apply regardless of what these Terms say.

12. Family sharing

Family sharing is a Premium feature. There is no separate Family plan and no separate price: one Premium subscription carries the shared space.

  • A Premium subscription creates one shared family space, owned by the subscriber.
  • The space holds you plus up to 5 family members — 6 people in total. Invitations that have been sent but not yet accepted count against that limit until they are accepted or withdrawn.
  • Members join with their own NxtDue account and their own sign-in. They do not pay separately, and they do not need Premium of their own to be a member.
  • A member can see the reminders and documents that are shared into the space, and nothing else in anyone's private account.
  • The owner can remove a member at any time. Removal takes effect immediately: that person loses access to everything shared in the space, and keeps only what is in their own account.
  • The owner is responsible for who they invite, and for the subscription itself.
  • A person can belong to more than one family space, but can own only the space attached to their own subscription.
  • If the owner's Premium subscription ends, the space is not deleted — its sharing is paused, as section 10 describes.

13. Storage limit

Document storage is included on both plans: 100 MB on Free and 1 GB on Premium. Where a Premium subscriber shares a family space, that 1 GB is shared across the whole space, not counted per member. Usage is measured as the total size of the files you have uploaded and not deleted, and you can see how much you have used in the app under Settings → Storage.

If you reach the limit:

  • New uploads are refused until you free up space. The app tells you why, at the moment you try.
  • Nothing already stored is deleted or altered. We do not delete your files to make room, and we do not delete them for going over.
  • Existing documents stay viewable and downloadable as normal on the plan you are on. The one exception is a Premium subscription ending with more than 100 MB stored: the files beyond your first 100 MB of uploads are locked, not deleted — section 10 describes exactly what that means and how they are unlocked.
  • To free up space, delete documents you no longer need. The space is released immediately.
  • Individual files are also subject to a per-file size limit, shown in the app.

We may refuse or remove a file that is unlawful, that infringes someone's rights, or that puts the Service at risk — and we will tell you if we do.

14. WhatsApp reminders

WhatsApp reminders are not yet available. They are planned as a Premium feature in a later release, and this section describes how they will work once they arrive. Until then they cannot be turned on, and a Premium subscription does not include them. When available, WhatsApp delivery will be off until you switch it on and give us a number that can receive WhatsApp messages.

  • We send only renewal reminders for reminders you created. We do not send marketing on WhatsApp, and NxtDue does not hold conversations there — replies to the number are not read.
  • Messages are sent through the WhatsApp Business Platform, operated by Meta. To deliver one, your WhatsApp number and the details that appear in the message (the reminder's title and its date) are passed to Meta. Meta's own terms and privacy policy govern what it does with a message once it is on its platform.
  • WhatsApp requires business-initiated messages to use a pre-approved template, so the wording is fixed. That is a platform rule, not a choice we make per message.
  • You can turn WhatsApp delivery off, or change the number, at any time in Settings. Delivery stops immediately, and turning it off deletes the number from your notification preferences.
  • Delivery is not guaranteed. It depends on WhatsApp, on your number remaining registered with it, and on Meta's own delivery rules — see section 20.
  • Availability can vary by country, and where WhatsApp delivery is not available to your number the reminder still arrives by push notification and email.

15. Email receipt detection

Email receipt detection is not yet available; it is rolling out in a later release, and this section describes how it will work once it arrives. It will be optional and off by default. If you turn it on, you connect a Google account and grant NxtDue read-only access to your Gmail so it can look for renewal and receipt messages.

  • NxtDue cannot send, delete or modify your mail.
  • What it finds becomes a proposal you review. NxtDue never creates a reminder from your email on its own.
  • We do not store the body of your email — only the few fields a reminder needs.
  • NxtDue's use of information from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.
  • You can disconnect at any time in Settings, which deletes the stored token, or revoke access from your Google account.
  • Detection is automated and imperfect. It will miss things and occasionally propose something wrong. Check what you accept.

16. Changes to plans and prices

We may change what a plan includes, or its price. If we increase the price of a plan you are on, or materially reduce what it includes, we will give you at least 30 days' notice in the app or by a message to the email address on your account, before the change applies to you. The change takes effect at your next renewal after that notice.

You do not have to accept it: cancel before the renewal date and you will not be charged the new price. Where the store requires your explicit consent to a price increase, the subscription will not renew until you give it.

17. Availability and changes to the Service

We aim to keep NxtDue running, but we do not promise it will be uninterrupted or error-free. Maintenance, outages at our providers, and problems outside our control all happen. We may add, change or withdraw features.

If we discontinue the Service entirely, we will give you at least 60 days' notice so you can export your data, and we will refund any period you have paid for that falls after the shutdown date.

Features labelled beta or preview are provided as they are, may change or disappear, and are not covered by any commitment in these Terms.

18. Suspension and termination

You may stop using NxtDue at any time. We may suspend or end your access if you materially breach these Terms — in particular section 6 — or if we must do so by law, or to protect the Service or other users.

Except where the breach is serious or unlawful, we will tell you first and give you a reasonable chance to put it right. If we end your account for reasons that are not your fault, we will refund the unused part of the period you have paid for. You can export your data before you go; see section 19.

19. Deleting your account

You can delete your account yourself, from Settings → Privacy & security → Delete account in the app. You do not need to contact us and you do not need to give a reason. You can also request deletion from nxtdue.com/delete-account without the app installed.

When you delete: you are signed out on every device immediately, every active session is revoked, and your email address is released. Your data then remains recoverable for 30 days — so that an accidental tap is survivable — and is permanently deleted after that. Anything you shared into someone else's family space stops being visible to them at once.

Deleting your NxtDue account does not cancel an active App Store or Google Play subscription. Cancel that in the store first — see section 9.

20. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

In particular, and repeating section 4 because it matters: we do not warrant that a notification will be delivered, that it will be delivered on time, or that any date, amount or detection in the app is correct. Automated detection from email is a convenience, not a verified record.

Nothing in this section excludes a warranty or right that cannot lawfully be excluded under the consumer law that applies to you.

21. Limitation of liability

To the maximum extent permitted by law, the operator is not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, goodwill or data, arising out of or in connection with the Service — including any loss caused by a reminder that was late, missing, or wrong, such as a lapsed policy, a missed renewal, a penalty, or a subscription that renewed when you did not want it to.

Our total aggregate liability to you for all claims in any 12-month period is limited to the greater of (a) the amount you actually paid us for the Service in the 12 months before the claim arose, and (b) ₹1,000 (or the equivalent in your billing currency, approximately US$15).

These limits do not apply to liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or to any other liability that cannot be limited or excluded under applicable law. Nothing here affects your mandatory statutory rights as a consumer where you live.

22. Additional terms for the Apple App Store

If you obtained NxtDue from the Apple App Store, the following applies, and prevails over anything inconsistent elsewhere in these Terms:

  • These Terms are between you and the operator only, not with Apple. Apple is not responsible for the app or its content.
  • The licence granted to you is a non-transferable licence to use NxtDue on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for NxtDue. Support is provided by us, through our support page.
  • If NxtDue fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
  • We, not Apple, are responsible for addressing any claim by you or a third party relating to NxtDue, including product liability claims, any claim that it fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
  • We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that NxtDue infringes that party's intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and on your acceptance of them Apple has the right (and is deemed to have accepted the right) to enforce them against you.

If you obtained NxtDue from Google Play, your use is also subject to the Google Play Terms of Service, and Google is not a party to these Terms.

23. Governing law and jurisdiction

These Terms are governed by the laws of India, where the operator is based. This choice of law does not deprive you of the protection of any mandatory consumer law of the country you habitually live in. Subject to any right you have as a consumer to bring proceedings where you live, the courts at Nellore, India have exclusive jurisdiction over any dispute arising from them.

We would much rather sort a problem out by email first — please write to us before anything else.

24. The rest

  • Changes to these Terms. We may update them. If a change is material we will tell you in the app before it takes effect, and the date at the top always reflects the current version. Continuing to use the Service after that means you accept the new Terms; if you do not, delete your account.
  • Whole agreement. These Terms and the Privacy Policy are the entire agreement between us about the Service.
  • Severability. If a provision is found unenforceable, the rest continues to apply.
  • No waiver. If we do not enforce something straight away, we have not given up the right to enforce it later.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours if the Service changes hands, and will tell you if that happens.

We acknowledge grievances within 48 hours and aim to resolve them within 15 days — the timeline Indian law requires of us, which we apply to every user wherever they are.
